UK Supreme Court ruled not to conduct autopsies if families disagree and settle for alternative testing

London's Haredim no longer afraid to die


Orthodox community in London, recorded today a historic achievement: Supreme Court in London, ruled today (Tuesday), the families of the deceased who refuse to conduct an autopsy on religious grounds, can be satisfied with the non-invasive test using a magnetic device resonance imaging (MRI), X Ray and more.

"This is a breakthrough", sat the Orthodox community of London. "Up until now there were judges who claimed that if we disagree on religious grounds, we can verify the reason for the death using a blood test or X-Ray, but the law didn’t change. Today the judge ordered to anchor the law ruling and amend the law.

One of the activists of the committee who dealt with the matter said: "The situation here in England was absurd. People were afraid to die here and that the chief medical examiner will delay the funeral for days or even require an autopsy. There were cases where the burial was delayed for an entire week. A year ago a meshulach from Jerusalem, Rabbi Mordechai Halevi Weiss, died. For a week pathology delayed the death certificate and eventually he was buried a week after his death.

"This is the chief medical examiner that made difficulties for Jews and Muslims two religions that oppose autopsy. Someone who died on Friday had to wait until Monday, the chief medical examiner refused to answer the phone or requests, not during working hours. The situation was intolerable, until a group of Haredi activists decided to take the matter into their own hands, we hired the best lawyers, we checked all the cases they had dealt with the chief medical examiner and found that there were cases in which the cause of death was confirmed only on the basis of a blood test, or a fingerprint.

Asher Gratt head of the organization, "Adas Yisrael," says: "People in the community who have lived in fear of an autopsy can now breathe a sigh of relief."
