Hagry"s Eliashiv: "One must take out the Niftar".
The question regarding moving the grave of the Chessed personality was raised twice on Harav Eliashiv's table. Five days before he was hospitalized, the family asked Hagrb"z Kook to present the question for the last time. Watch the Psak

At midnight: last Thursday night, the body of a well known Chessed personality in Jerusalem was moved out of the Sanhedria graveyard to Har Hazeisim.
The members of family debated the issue for many months.
They received a heter to move the body, from Hagr"s Wazner, Hagr"o Yosef and Gab"d of the Eda - Hagry"t Weiss, but they feared to make the move before they receive a psak from Hagry"s Eliashiv ztk"l.
And so they found themselves on a winter morning, going up to the famous house on Chanan street.
Hagry"s Eliashiv ztk"l heard the details of the story from his Talmid, Hagaon R' Ben Zion Hacohen Kook, in the presence of the family members, and ruled that one must move the niftar's body.
The psak halacha of Gedolei Yisroel which is brought here, is based on the words of the Shulchan Aruch (Yoreh Deah, 362, 5) "One does not burry a Rasha by a Tzadik, even a severe Rasha by a light Rasha, and one does not burry a medium Tzadik and kosher person by a supreme Chassid"
The members of family were overcome by their conscious, and did not know whether the psak is an obligation or just in terms of a heter.
It was on Tuesday, Parshas Beshalach, five days before the last hospitalization at Sha'arei Tzedek.
Hagrb"z went in to ask again, on behalf of the family – if the psak is an obligation or just a heter.
In a rare video clip which reached "Behadrei Hareidim", Hagry"s is seen very weak, but with a clear mind, and he remembers the question – and pinpoints the answer.
"There were two chassidish avreichim here," tells Hagrb"z in Yiddish, and later on turned to Hebrew, "They had an important father, who wrote in his will to burry him in the Sanhedria cemetery. I told the Rav that after they buried him, they came to the grave and were appalled – they suddenly saw that next to him are buried those who were perhaps Shomrei Shabbos, but certainly not meticulous in Mitzvos. The families came in terrible pritzus. The Rebbe said that they could move him to Har Hazeisim".
Hagry"s ztk"l answered: "Avaday!" (certainly)
Hagrb"Z: "Now they are asking if it is an obligation to move him because of the din of Kibbud Av".
Hagry"s: "Certainly. One must".
Hagrb"Z: "Is it an obligation because it is derogatory for the father to be in such a place?"
