More than a Year In a Cheirem and Still Living it Up



Mr. Hermann Fried (Known as Hershey Fried, 66),a Viznits Chosid, after being in Cheirem for more than a year, is still refusing to grant a divorce (Get) to his wife Susi. Surprisingly there are still few synagogues and Rabbies that don't fully respect the Cheirem in several ways and the the refusenik finds his way around Shuls and Shiurim, hiding the truth and giving over twisted versions of the case. The background story is as following:

Susanne Schlaff and Herman Fried (Zvi Hirsh, known a Hershy) got married December 1990 and lived in Tel Aviv Israel for 22 years. Around 4 years ago Susie left the common house as life together became unbearable for her, without getting into further details.

She filed a request for separation of the household in the Israeli family court followed by a request for a divorce in the rabbinical court of Tel aviv and received backing from the rabbinical court which gave a ruling that her husband is forced to give her a Get. After Hershy appeared on the day they set for the Get but denied to grant it, the state of Israel also issued a ruling against Hershy to leave the country (Tzav Ikuv Yetzia) until things settle.

After filing an appeal against the court's ruling, in the high rabbinical court , the appeal was dismissed and Mr. Fried ended up with an ever harsher verdict and was ordered by the high rabbinical courts that he must give the Get immediately.

After realizing that there is no way out but to give a divorce, Fried fled the State of Israel in a criminal way refusing to abide the ruling of the state of Israel(צו עכוב יציאה, Tzav ikuv yetzia),As well as the ruling of the high Rabbinical Court.
As a result of his refusal to obey the high court's rulings, the Rabbis put all kind of sanctions on him, including the issuing of a ‘Cheirem’ on the husband of the Aguna (chained woman), stating that in light of his refusal to give a Get according to Halacha, he must be ostracized and treated according to the Rabbeinu Tam rulings, as stated in the book, “Tzitz Eliezer”.

The Rabbinical court also quoted the distancing obligations, as seen in the copy of the Cheirem above, and added that until he grants a divorce to his wife, the aforementioned rabbinic rulings (the so called separations instituted by Rabeinu Tam) apply to the husband and are to be effective wherever he may be. In addition, the husband's name picture, and details are allowed to be published everywhere.

Throughout his travels around America, Fried tells untrue facts about the Cheirem and the Divorce. He claims that the Cheirem is not valid abroad and that he is in the midst of negotiations to grant a Get and therefore the Cheirem is no longer valid. Theses claims are unaccepted by the Rabbis and Rabbinical court, and the the Cheirem is still valid and held against him in full.
