Justice Minister Ayelet Shaked is presenting a new regulation today that if passed would require divorcing couples to first attempt family mediation before going to either Beit Din or Beit Mishpat.

Justice Minister Ayelet Shaked is presenting a new regulation today that if passed would require divorcing couples to first attempt family mediation before going to Beit Din or Beit Mishpat.

The process of mediation will take place near the family courts , in order to ascertain whether it would be possible to work out a divorce agreement with the full cooperation of both parties. Each couple will be given four free sessions without the presence of lawyers.

They will receive guidance on how to conduct the mediation process , and will be given the opportunity to either come to an agreement or return to court or Beis Din in the event that they are unable to come to an agreement.

Justice Minister Ayelet Shaked said," Mediation should be a viable alternative to the damaging custody battles that often play themselves out in the court system. In many cases it will be possible to avoid legal battles all together , whether in Beit Din or Beit Mishpat. This will be very beneficial for the overburdened court systems, and will help divorcing families to come to a mutually agreeable decision.
