The District Court decided today (Monday) to ease the arrest conditions of the defendant who attacked Nati Grossman, editor of Hapeles.

According to the decision, the defendant may go to morning and afternoon prayers on a weekday and Shabbos prayers, accompanied by one of his relatives.

Attorney Hirsch Cohen representing the prosecution argued that "the time has not come for alleviations." He explained, "Not enough time has passed since the indictment and the event. Currently we do not agree that he should be released to leave for prayers. He should stay in full house arrest, "he said.

In contrast, Attorney Tzenach Green representing the defendant said, "I am thrilled every time by the state and not for the better. The only danger which arises objectively from the report is the fact that he is a British citizen. That is the only thing going against him."

His lawyer tried to suggest that he should be given a restrain order from going to Bayit Vegan (where the attack took place YA) or return to the Ponovicz yeshiva where he learns or another yeshiva. "I ask to please not punish the brother and father to accompany him all the time."

Judge Ram Weingrod who gave his decision after hearing both sides decided that the defendant could go to prayers three times a day with his father or brother. For this purpose, he can go to Morning Prayer from 7:30 to 9:30 am and to mincha he can go from 45 minutes before sunset. The judge also allowed him to go to prayers on Shabbos with his brother or father.

He concluded that if for 21 days he does not violate parole and he will be offered a suitable framework for studying Torah in his neighborhood, a request can be considered for reconsideration to allow him to leave to learn for a few hours a day.
